Filing the Alien Relative Petition Form is the first step in helping an eligible relative apply to immigrate to the United States and obtain a permanent resident card.
USCIS approves your petition based on proof of the relationship between you and the relative who qualifies to immigrate to the United States. Once the petition is approved, your relative can apply to become a lawful permanent resident.
If your relative is already in the United States and a visa is available, they may be eligible to obtain their Permanent Resident Card by filing the Adjustment of Status Form .
Some family members must wait until a visa number becomes available before they can file an application for Form I-485 (to adjust their status if they are already in the United States) or for a visa (if they are outside the United States). Visas are always available for family members who qualify as immediate relatives.
